Acceptance of terms
By accessing or using the Service, you agree to be bound by the terms and
conditions of this Agreement. If you do not agree to all the terms and
conditions of this Agreement, you may not use the Service.
Use of the service
Subject to the terms and conditions of this Agreement, we grant you a
limited, non-exclusive, non-transferable, and revocable license to access
and use the Service for your personal or business purposes..
Payment
The Service may be offered on a paid subscription basis. If you choose to
subscribe to the Service, you agree to pay all fees and charges associated
with your subscription. We reserve the right to modify our fees and charges
at any time, upon notice to you.
Intellectual property
The Service and its entire contents, features, and functionality, including
but not limited to all information, software, text, graphics, images, logos,
and icons, are the property of Finthesys/CloudFinish or its licensors and
are
protected by copyright, trademark, and other intellectual property laws.
User content
You may be able to upload, store, and manage financial data and other
information using the Service ("User Content"). You retain all ownership
rights in your User Content, but you grant us a non-exclusive, worldwide,
royalty-free, and sublicensable license to use, copy, modify, distribute,
and display your User Content for the purposes of providing the Service.
Confidentiality and security
We take reasonable measures to protect your User Content from unauthorized
access, disclosure, or use. However, no transmission of data over the
internet is completely secure, and we cannot guarantee the security of your
User Content. You are responsible for maintaining the confidentiality of
your login information and for any activities that occur under your account.
Prohibited conduct
You may not use the Service for any illegal or unauthorized purpose, or in a
manner that violates any applicable laws or regulations. You may not engage
in any conduct that could damage, disable, overburden, or impair the
Service, or interfere with any other party's use of the Service.
Termination
We may terminate your access to the Service at any time, for any reason,
without notice or liability. Upon termination, you must immediately cease
all use of the Service.
Disclaimer of warranties
The Service is provided "as is" and "as available" without any warranties of
any kind, express or implied, including but not limited to warranties of
merchantability, fitness for a particular purpose, non-infringement, or
availability.
Limitation of liability
In no event shall Finthesys/CloudFinish be liable for any indirect,
incidental,
special, consequential, or punitive damages arising out of or related to
your use of the Service, even if we have been advised of the possibility of
such damages. Our total liability to you for any and all claims arising out
of or related to the Service shall not exceed the fees paid by you for the
Service during the twelve-month period preceding the date of the claim.
Changes to the agreement
We may update this Agreement from time to time. We will notify you of any
material changes by posting the new Agreement on our website. Your continued
use of the Service after the effective date of the revised Agreement
constitutes your acceptance of the revised Agreement.
Governing law
This Agreement shall be governed by and construed in accordance with the
laws of US, without giving effect to any choice of law
